Plaintiffs Bertram Riddick, Jeff McLaughlin, and Bruce Greenberg have sued WDI International, Inc. d/b/a Tony Roma’s (“WDI”), claiming that they and other customers of the bar area at the Tony Roma’s restaurant formerly located at 24301 Crenshaw Boulevard in Torrance, California, who purchased drinks from the Happy Hour menu during the Monday through Thursday “Buy One Drink and Get the Second Drink for $0.99” and Friday “First Drink Is $0.99” ladies’ night promotions (the “Ladies Night” promotions”) held there for the period from April 1, 2012 to May 31, 2013, were treated unequally by paying different prices for their drinks based on their gender.

WDI denies all of the claims and allegations in the above two related cases, denies that Plaintiffs are entitled to any relief in this case, and denies that absent a settlement, any class should be certified. By agreeing to settle, WDI is not admitting liability on any of the factual allegations or claims in the case.

A proposed class action settlement has been reached between Plaintiffs and WDI (the “Settlement”).

Plaintiffs and WDI recognize the costs and risks of litigation, however, and believe that the proposed Settlement is a fair and reasonable resolution of this case.

CLASS DEFINITION

All persons, regardless of gender, who purchased a beverage from the happy hour menu at Tony Roma’s in Torrance, California during its Friday “First Drink Is $0.99” Ladies Night promotion from April 1, 2012 to May 31, 2013, and can show proof of purchase; and

All persons, regardless of gender, who purchased two beverages from the happy hour menu at Tony Roma’s in Torrance, California during its Monday through Thursday “Buy One Drink and Get the Second Drink for $0.99” Ladies Night promotion from April 1, 2012 to May 31, 2013, and can show proof of purchase.

YOUR RIGHTS AND OPTIONS UNDER THE SETTLEMENT

SUBMIT A CLAIM

If you want to receive a monetary payment from the Settlement, you must fill out and submit a Claim Form along with supporting information. Click here to submit your Claim online or Click here to download a Claim Form.

If you choose this option and submit a timely and valid Claim Form, and if the Court grants final approval of the Settlement, you will be a Participating Class Member and mailed a check in your Individual Settlement Amount. Additionally, you will be giving up your right to sue separately.

OPT OUT OF THE SETTLEMENT CLASS

If you do not want to give up your right to sue and want to Opt Out of (or “Exclude” yourself from) the Settlement Class, you must fill out and submit the Exclusion Form along with supporting information. Click here to download an Exclusion Form.

If you choose to Opt Out of the Settlement Class, you will not receive any money from the Settlement.

To be valid, any Exclusion Form must be postmarked, faxed, or e-mailed on or before December 12, 2016 and must include the required supporting information.

OBJECT TO THE SETTLEMENT

If you wish to object to the Settlement because you find it unfair, inadequate or unreasonable, you must submit a written objection telling the Court why you don’t like the Settlement.

If you object to the Settlement, you will still be entitled to the money from the Settlement, but only if you complete and submit a valid Claim Form. Otherwise, if the Court overrules your objection, you will be deemed to have released the Released Claims.

To be valid, any objection must comply with all of the required procedures (please see the Notice Packet or refer to FAQ 13 for additional information) and must be postmarked, faxed, or emailed no later than December 12, 2016.

DO NOTHING

You may also do nothing. If you choose to do nothing, and if the Court grants final approval of the Settlement, you will be deemed to have released the Released Claims even though you will not receive money from the Settlement. If you do not want to be deemed to have released the Released Claims, you must Opt Out from the Settlement.
